Good step taken by the Apex court.. This declaration about the validity of Fatwas was long awaited. Yes, I agree with the court's statement, "no religion allows punishment of innocents."

Muslims have not opposed the decision. The suprme Court has not illegalized the shariat courts. Only the Fatwas are not legally binding. These are like panchayat decisions and just opinion. If the parties accept the fatawa, there is no issue. But if any party does ot accept the Fatawa, this will not be binding.

There cannot be common law on matters of personl law affecting communities only. On succession, inheitance, marital relation, divorce, there can be no common law. Clamor for common law on all matters is actually an attempt by Hindu fundamentalists to force Hindu law on all citizens.

It's not clamor, but the need of the hour to have a common law. To avoid such situations a common law is needed.

It's not clamor, but the need of the hour to have a common law. To avoid such situations a common law is needed.[/quote

There is seperate law on property inheritance, marriage, divorce etc on Hindus, Muslims, Christians and also a common civil marriage law. There is no way you can introduce common law in these situations. Will you comel Muslims and Christians to marry before a Hindu priest and move around fire. Or will you ask Hindu and Christians also to get Nikah before a Maulvi. Common law is only for matters that are common to all communities. Matters concernin a community only are personal and there can be nothing common about this. I reiterate that the clamour for common law is a fascist design to force Hindu law and traditions on minorities.
