We can never call any court incompetent since it is respected within the country and the same would be said of our law courts as well ! It is with reason that a summon was given because she is in charge of the affairs of Congress party being the widow of Rajeev Gandhi and d in law of Indira Gandhi . Summons are normally given by anyone who is ready to do so, even in our session courts you see summons being given by various people doing voluntary service and are paid a certain sum for doing so...Jut because she is made out to be a great person here , she doesnt need any special person to give her summons since she is an ordinary person there ..

The U.s. court is incompetent in the sense that they have no jurisdiction on matters occurring in India. Their attitude is attack on our sovereignty and is caused by colonial and imperialist set of mind. A court can not have jurisdiction in matters in other countries. This is not a case of country only. A court in Jaipur has no jurisdiction on a crime that occurs in Delhi. Just recall sant asharam case. The case was tried by Jodhpur court in Rajasthan even though complaint was made in Delhi. Perhaps some would not mind even Asha ram case being tried by a U.S. court. This is simply funny.

funny, nonsense or whatever but why should they keep mum, They have right to say NO. Also, the party being summoned has the right to object to the issuance of the summon, if it is for an improper purpose, such as summon records that have no relevance to the proceedings, or of persons who would have no evidence to present. I don't think Sonia has anything to say in this matter.

It is not that easy , once the summons has been served to her personally through the night staff and the security personnel of the hospital , she has 21 days of time to respond...We cant stand on ceremonies saying she is a big shot here and that her summons should be served ceremoniously, all are equal before the law.. In fact Sonia Gandhi is not even a naturalised Indian citizen so she can be served notice anywhere in the world...

It is not the nationality of person but place of offence that determines jurisdiction of court. The said offence of Sonia Gandhi is in jurisdiction of courts in India. Any court outside India is not competent to adjudicate any offence that is committed in India irrespective of nationality of the 'offender'. To elucidate, if an American citizen is guilty of an offence in India, he is subject to jurisdiction of court in India and not U.S.A. Here I may recollect the offence by an American youth in Singapore. He was guilty of graffiti on wall for which he was sentenced to caning. Even intervention by U.S. govt. could only result in reduction of cane strokes. The U.S. govt could not have taken the plea that their citizen should be tried in U.S. court.
