Consensual sex with girl below 18 yrs no offence under POCSO

Consensual sex with a girl, who is below 18 years of age, would not amount to an offence under the newly enacted Protection of Children from Sexual Offences (POCSO) Act, a Delhi court has said.

Obviously consensual sex means that there is no coercion. The act aims at protecting children. If there is no force used against and the girl herself willingly participates in sex, what protection and against whom she needs.

There are two sides of this discussion.. One if girl is not mature enough to understand the exact physical needs.. other could be nothing wrong in taking decision when u what ur doin...

There are two sides of this discussion.. One if girl is not mature enough to understand the exact physical needs.. other could be nothing wrong in taking decision when u what ur doin...

The judge said that govt. is not master or owner of physical bodies and so cannot say why a girl had sex with somebody. She would be protected only if somebody forced sex on her. Actually this is question of morality which is not in domain of courts. It is for parents and schools to properly groom and guide the children. .

For that matter no crime is an offence until reported. Most criminal never face trial because no one reported the crime. Same is the case here if a girl does not want to report is considered as willing partner, reasons maybe varied, may be too afraid, paid, even willing partner or whatever.
