    The wife has right to maintenance and conjugal rights and not property earned by her husband. Inheritance of house and other property arises only on death and the legal position differs for different communities. Such matters need consultancy with an advocate of civil cases.

    Not even if the property is in joint name, I think if a property is jointly hold by wife and husband they should have the equal right on that> What do you think Gulshan Sir?

    Joint name is only to facilitate transfer on death of first holder or first name in an account. The succession is either by will or by operation of law. If some body dies intestate i.e. without making a will, court will decide the matter of succession. The stake holders to deceased property may move court for decision. For better discussion, it is necessary to consult an advocate on civil cases.

    actually its real case

    & scenario is

    she is thrown out of her house exactly after 1 year marriage by her hubby with 1 lakh salary /month without any reasons just bcoz she earns less than him & her family couldn't met dowry demands

    she was divorce which was shock to her on new year eve, & hubby did xtreme steps so easily just bcoz she dn't hve father .

    Also y hubby divorce exactly after 1 year as she had nothing in her name neither ration card,nor property as her hubby had never ever took initiative & was planing 2 divorce her

    so plz tell me how divorce women can add or apply name for property ownership & what are rights of women in such case legally

    Yes it is legally allowed for a women to apply for ownership of house if she wants.

    The woman has to consult a family court advocate. Court may award he monthly maintenance after hearing her case, reason for desertion by husband, her financial status and earning. It is not possible to solve the issue in the forum.

    She would have right to maintenance but not property. A man remains owner of his property till his death after which this would be passed on according to his will or by order of court.
