A very informative article. Also, the para "Applicable tax exemptions and rebates" is very important and should be taken care of while buying any property. " However, you cannot enjoy any tax rebates if you buy the property in your wife's name, and this holds true even if you are the co-applicant of the loan as even co-applicants of home loans are not eligible to receive tax concessions." this will make men to think twice before buying property on their wife's name.

There is another added disadvantage to wives, when there is marital problem , th husband will claim the property back stating it was benami transaction,Such a thing has happened to someone I know.Ideally any property bought after marriage should be bought in both names...

Yes, I agree. But in this article it also say that the co-loaner will not get any tax benefit. In current times, both women are men are earning and in such a case both would want to accrue tax benefit..which is missing. This is also a valid point to ponder upon.

Buying a house in wife name gives satisfaction to both husband and wife. If the house he bought is the first one then he should register the house with his name and second house with her wife name so that he have the feeling of having the own house in his name for the hard work he has committed during those early periods.

Very true, I have done it to save registration charges that is lesser for women in our state. I think wife feels more secured with these small steps.
I think it is the same in all states, if I am not mistaken it is 1 percent less for women...Basically it is the mutual respect and feeling that counts and in most cases men do it for convenience and not bother about the wife's feelings. If there is any misunderstanding they will immediately change the title ddeds in their names which happens so many times....Instead if it is done in both names women get a better deal !

It is not simply a sign of respect but also to ensure a woman's security and share in estate that the home should be registered in wife's name. In my state, when a man is buying a home, it is mandatory for him to register it in his own as well as the wife's name. The law came into existence a few years ago, the registration has to be done together as a couple./

I don't know about other states but in UP and Karnataka only. In UP my wife is the only owner and in Karnataka she owns a land combined with my daughter that has saved us on registration charges.

Also, a wife will get a loan amount easily in instances where husband has already taken car loans or similar loans. Also, it is always good and ideal to get the home registered on both husband's and wife's name. If this is a rule in a state..it is indeed a good rule.

According to my lawyer there is no such rule Kalyani anywhere in India, thats why there is so much of confusion.They have been wanting to bring in a rule where any property bought after marriage has to be registered in both names but so far it is in papers only...Some lawyers and housing societies advise the married couple to register in joint names but it is apparently not mandatory !
