    I find this amazing ! It has too many far reaching implications and we can see how the unscruplous take adavantage .Sajjan Kumar Singh accused in 1984 riots is already planning to take the issue upto court since CBI was the one that was involved in the investigation, and this is only the beginning...

    Pay no mind to those who talk behind your back, it simply means that you are two steps ahead !!!

    I read this news.CBI is central government agency. In this way any courts ruled that this and this agency which is establish by central government is unconstituational. Like CAG, CLB and more.

    I read this news.CBI is central government agency. In this way any courts ruled that this and this agency which is establish by central government is unconstituational. Like CAG, CLB and more.


    C.B.I. was formed according to Delhi Police act. The act was not signed by President and not even seen by him. again law and order is state subject and so C.B.I cannot be treated as police organization and allowed to arrest people and prosecute them. But so far nobody challenged C.B.I.- not even Supreme court. With Gauhati High Court decision, a new crisis has surfaced.

    But CBI is working in all states. Every state has special CBI courts. Yes it is crisis.

    What I can gather from this decision is that the law we have in this country is too complicated for even courts to understand and decide what is constitutional. I fail to understand if this is so complicated case for courts, how would an ordinary understand his rights. The need is to make laws simple, clear, transparent for every one to understand without having any bylaws even if they have to write the law-books all over again. Half of the pending cases will go immediately.

    Gauhati High Court said on Wednesday that the CBI cannot be treated as a police force; it can only conduct "inquiries".

    So with such unconstitutional organizations working in this nation and the governments using them as the tools to intimidate and bully its political rivals since 1963 ?
    What a Nation we are living in !!!
    And the wonder of wonders is our Apex court is validating the CBI and banking on the agency to ensure justice..

    The fact was brought to light by an ordinary citizen and an employee of Mahanagar Telephone Nigam brings shocking facts about the validity of our ‘Constitutional experts’.
    Now it has to be seen how many such unconstitutional organizations are functioning in this country.

    Its a different issue. The issue is how CBI could act, investigate arrest annexe the properties if its an unconstitutional body since 1963? What about those who are in prisons on the charges of CBI?

    Its a different issue. The issue is how CBI could act, investigate arrest annexe the properties if its an unconstitutional body since 1963? What about those who are in prisons on the charges of CBI?
    CBI has never been constitutional body, as the power derives can only be known from its formation and the honorable court judgment can be seen like this but still apex court ruling is awaited on this.
