I think The chief justice H.L Dattu's version is right. Freedom of expression has been granted by the constitution to the citizens of India. Hence porn cannot be banned in India.

Prey why should porn be banned.Those who do not like it do not watch/read it.. Vegeterians want non veg foods to be banned. Lot many want fast foods like KFC etc to be banned. Why puritans want to come in way of others . Let them keep to them selves.

Even if they want to, they cant ban it. In fact there is so much of it on intrrnet /in ptint, it can't be stopped.

There is no meaning in banning porn. There are many other dangerous devils other than porn. Consumption of liquor and drugs are more dangerous than watching porn sites.

Some of our films have such suggestive scenes that they are far worse since they get a U certificate ...What justice Dattu has said is that watching porn in your home is no offence and rightly so..

Justice Dattu delivered his verdict in no uncertain terms that banning porn violates the freedom of expression. There is no confusion about the verdict.

 

Sunil ha rightly observed that it is not feasible to ban porn on internet owing to the volume involved. What cannot be corrected must be tolerated. Otherwise if porn is okay on internet why this should be banned in books, fims and TV. So this is just a question of feasibility. 

More than anytime internet has become an indispensable aspect closely entwined with our lives. Its importance and worth are increasing day by day.. Owing to this reason India too started a massive programme of "Digital India." Information will be available in a moment, which is the need of the hour in the present scenario of speed.

Generally porn is rampant in internet, though the other forms of porn in print (Books and Magazines) and the movies are there, internet in particular cannot be banned as it has many benefits in the present days.

As you said, the only way is to tolerate porn.

 

 

 

Whenever anything is banned , those who want it get it be it liqour or porn. So why this hypocritical approach. Leave it to the citizens choice.

True...people have right to watch what they like much like right to do other things. As long as they do it within the confines of their home and are not harming any one, there is no problem. In fact, many of the B grade films and the item songs are as good as soft porn.

I uphold the views of the justice Dattu of Apex court. In no uncertain terms he said  "watching porn in your home is not an offense "

This is a landmark verdict.

True Kalyani ! I also find public display of intimacy here not very appealing ...it is a different matter in Western countries since they show affection publicly all the time and it somehow blends in with the scene but here when you suddenly come across couples in parks or other public places sometimes in compromising position it is too embarrassing  since you can also be sure that there are a few weirdos keeping watch . I wonder when our society would grow up and take love and intimacy in their stride..

Orthodox or Permissive Society you live in decides the ideal behavior pertaining to Display of intimacy or otherwise. I know in an orthodox society when one of the partners hold the hands of the other, the other partner moves away reprimanding, "What do you think, are you living in America ? "

I'm of the opinion there is a place and time for exhibiting intimacy ( Or related to intimacy.) Which is why the Supreme court specifically said, "In Your Home." This gives a hint do anything within the confines of your home. It's not illegal.

Internet is unstoppable and it cannot be banned due to existence of so many content management system all over the world, even country like China not been able to ban most of sites which derails their political thoughts, so as to say the said subject is difficult to ban. 

While agreeing for all the points pertaining to the benefits of internet, here I would like to add the legal aspect involved.

The Apex court strongly felt, Banning Internet, including porn amounts to suppressing the Freedom of expression. Combining these two aspects, yes internet cannot be stopped.

From the apex cout decision it appears that watching porn at home or at isolated place is okay but not in a cyber cafe. I remember that some time back agra police arrested people in cyber cafe for watching porn.

At Agra also the managersof the cyber cafe were arrested. The watchers were also arrested.  Just as you can't watch porn in cinema hall, you can't do in cybercafe as well.
