Information Commission has decided that the recognized political parties are liable to give information under the RTI Act. This is likely to be opposed by political parties who already give information to Election Commission.

Good move! Its high time since political parties were made answerable to the public! I just hope that it is used wisely to curtail corruption!
But only Congress, BJP, Bahujan Samaj Party, Communist Party of India and Communist Party of India (Marxist) have been asked to give information. Other parties like TMC of Mamata Banerjee, Samajvadi party of U.P., DMK etc have been left out. Many of tese are also ruling. CPI, CPI(M) and BSP have really no power but they are in the net.

That is ridiculous, all parties ruling or otherwise should be made accountable with RTI, even if they are not ruling, they still accumulate party funds and are involved in a lot of projects and such. So no one should be ideally left out!

As you said, Motilal Vora, treasurer AICC stated in a letter to CIC that AICC did not come under the purview of RTI act because it was not a public authority.. However CIC rejected the contentions made by the political parties.

Technically, Motilal Vora is correct. CPI Secretary Raja gave all information to commission stating that they had nothing to hide but added they technically they are not in RTI Act. Tie Information Commission has considered 'Election Commission' as appropriate government, which is ridiculous. Only central or state government can be appropriate government and not Election Commission, which is not a government at all. The political parties already give all their information to election Commission. apparently, Information Commission is manipulating things. It has become habit of statutory authorities to exceed their real authority and power. Earlier this was C & A.G.. Now this is Information Commission.

Irrespective of the statuary authority, the need of the hour is mandatory accountability. My opinion is that all the political parties big or small, national or regional should be brought under the purview of RTI .

Let us understand the purpose of RTI. This was supposed to be for getting information on government departments that M.P. or M.L.A only could ask for. The organization outside government are not supposed to be in RTI jurisdiction. For example, corporate sector information is available with Registrar of companies. It will make no sense to bring companies under RTI. similarly political parties are not either wings of government or any way working under government. They give all necessary information to Election Commission of India. It will make no sense to take them within RTI jurisdiction.

Thank you for the detailed information. My intention is, if not RTI, there should be some other law that makes the political parties’ accountable for their income and expenditure.

True. Crime walks two steps ahead of law.
Actually, Right to Information act applies only to organizations that are departments of government or bodies under government. Political parties may control government when they get sufficient number of MPs or MLAs elected. But they are independent of government. Under Right to information act, the concerned entity is under a state government or central government- named as 'appropriate government'. Political parties are not under any appropriate government' as such. The Information commission gives the argument that- 'Election commission' is 'appropriate government'. This is most ridiculous as then statutory bodies like C&AG, Registrar of Companies may also be termed as 'appropriate government'.
Another point is that political parties are associations of individuals committed to certain ideology. These are not creation of government. Parties like Congress, BJP (former Jana sangha), CPI, CPI(M) were not established under government. They also do not receive funds from government as wrongly stated bv the information commission. Getting accommodation on concessional rent is not public funding.
However, some sort of control is necessary on all organizations that are large bodies in which public are interested. Corporate sector is also such but that cannot be brought under RTI. Any member of public can get information on payment of prescribed fee from Registrar of companies. Similarly, political parties submit all their accounts and necessary information to election commission. any member of public can get desired information from election commission, who is under purview of RTI.
Howsoever good may be the motive, no authority including Information Commission is justified to go beyond law and jurisdiction.

True. Jurisdiction is almost untouched due to which there is some order in the country. When I learned from your recent post on Kapil Sibal’s views on having a say in the appointment of judges it created a shudder in me.

There is a Sanskrit word 'Maryada'. I think this means 'limitation'. every authority- executive, judiciary, legislative, quasi judicial has some rights and some limitations. all need do their best but within the well defined limitations. If limitation is crossed, havoc arises. We saw that crossing 'maryada' (limit) by ocean led to Tsunami. similarly, crossing 'maryada' (Laxman rekha) led to kidnbap of Seetha and consequently the Rama Ravana war.

100 percent true. The adage 'Lashman Rekha is relevant to all times.

Political of India who don't like to see faces of other is now one on this issue. They can be amend this rule is parliament.
Jaitley has opined that more than political parties, it is necessary to bring media and NGOs under RTI. The govt. owned media is already under RTI. Private organizations cannot be under this act. As regards NGO, there are some NGOs who receive grant from government. It will be okay to bring such NGOs only under the Act. But there is no sense in bringing other NGOs not receiving grant from government

Now government is bringing an ordnance to ensure that political parties are outside the scope of RTI.

No wonder. I expected it. Now there won't be any opposition to pass the ordnance.
Government does not seem in a hurry to contest the order bringing the six nation level recognized political parties under RTI. However, most political parties have not yet complied with RTI requirements. Only the Communist party of India has disclosed source of revenue to the concerned person seeking information with promise to place the information on website. Howver, party has claimed that RTI is not applicable and they will not disclose the internal discussions.

Our political parties must lean to obey the harder way if they do not want to obey rules. If they do not follow instructions immediately their recognition should be suspended.
