It has been argued before Mumbai High court that sex between consenting adults of opposite gender is not unlawful and adultery is not a crime.
However right bethe opinion, law is what this is. Adultery is an offence under I.P.C. and a man can be chargesheeted. This is paradoxical as woman cannot be booked under the law. A man can sue another man but a woman cannot sue another woman for adulterous relation with her husband. Even then till law is changed, the provisions of law will stand as these are. .

It has been argued that adultery law considers woman as property of her husband. That is why husband of a woman alone has the right to complain against another man indulging in exptra marital relation with his wife. A woman cannot be sued. also a woman cannot complain against another woman having extramarital relations with her husband.
