No HC mercy for 80-yr-old

No factor like age should come in between when it comes to punish the guilty.

I agree with Abhishek. Our Judicial System is somewhat slow and it is necessary to give punishments to convicts irrespective of age otherwise justice won't be complete.

Punishment and reward are inseparable from social system. Every offender must be punished. age, gender etc. should not be considered in rewarding or punishing.

Crime is crime who so ever do it should be punished . If mrcy is given than crime will pampered and in the laps of some class of people.

But see how long it had taken to grant the judgment?. That is the so called beauty of our judicial system.

I agree. Any consideration like age, gender, community does not matter. However, exception is made in case of children and mentally retarded. Culpable state of mind is the main consideration. Guilty mind or mens rea is the guiding factor.

Wow for a crime commited 13 years before he is punished now..he has enjoyed whatever he can get from life during this period..now i dont think the punishment is going to make any difference for him.

Delay in punishment gives no enjoyment. The accused has to go through long court proceedings and appear before court several times before final decision. This would not have given any enjoyment to the accused over whom the Damocles' sword was hanging all these years. Delay is good neither for judicial system nor for accused. Justice delayed is justice denied. Punishment may make difference or not. This depends on mental state of the individual sent to jail.

Punishment is never enjoyable but what i wanted to say is due to the delay the guy got time to do whatever he wants in life. If he was immediately punished for the crime maybe he could have regretted or could have felt guilty..I know that individual attitude is important here but in general crimes are committed in bad attitude only.

Every crime is committed with bad intention. What makes difference as regards attitude is that many never admit mistake and take pride in crime. That is why many criminals repeat same crime after completing jail term. Some take punishment seriously and are ashamed of crime. Others feel proud of their bad deeds. This is matter of individual attitude.
