'Civil society' not be used again in law drafting

It is good that it has dawned on UPA that 'civil society' should not be used in law drafting. Constitution does not provide involvement of unauthorizedand extra constitutiona process of engaging so called 'civil society' in law making. Drafting committee on Lok Pal including so called 'civil society' was first step of this kind.

Happily, Kapil sibal has stated that such experiment will not be resorted to in future. The question arises why such questionable experiment was carried out at all. It is obviously to sidetrack people's attention from CWG, Adarsh Housing and 2G scams. It is also worth remark that when UPA does not respect constitutional authorities like Parliament, JPC, PAC, C&G, it is not understandable how the extra constitutional and unrepresentative persons- Hazare group could be given genuine imprtance.

UPA yielded to undue pressure of so called 'civil society' led by Anna Hazare, which was nothing but a grouping of certain NGOs, ex bureaucrats and Sadhus and definitely not represented civil society as a whole. Kapil sibal has assured that such mistake of entertaining 'civil society' will not be attempted in future. The fact remains that UPA formed a law drafting committee including non representative members for own vestedf interests.

Although, Kapil sibal has stated that such experiment will not be repeated, strangely the draft Lok Pal Bill agreed to ministes and so called civil society perceive Lok Pal as an investigator, prosecutor, jury, judge all combined. This is obviously against basic tenets of constitution and parliamentary democracy. It is known fact that congress has least regard for constitutional propriety and parliamentary system.

Before a bill becomes an enactment it's a standard practice to have the views of all sections of society that is what is desirable in a functioning democracy.This practice has been going on ever since independence.There are many sites of the government where a bill is available for discussion and suggestion.Mr. Kapil Sibal's glib talk on this issue is neither convincing nor his conduct in this entire episode!
It is a good decision.Else there will not be value for people elected parliament.

Public discussion on a new law is definitely not a new thing. But the thing is formation of a law drafting committee with certain individuals posing as civil society representatives.

Let us be clear that a draft bill is not a law and a draft bill is the product of a long consultative process and nobody can question the supreme and sovereign powers of parliament to make laws and I am only referring to the consultativie process to which any member of society can be involved.

I agree. But the recent formation of committee for Lok Pal Bill was a new practice. Publication of a draft bill inviting suggestions or otherwise asking citizens to send their views is a different matter. It is not disputed that a bill has to be presented in parliament by cabinet. There can be also private member's bill.
According to BJP representative, Union Government mishandled the Lok Pal issue. A committee for law draft was constituted without any consultation with opposition. The 'civil society' members were first given undue importance and now the government wants them at arms length. However, BJP rep. refused to give views on the proposed law.

To my mind the Congress-led government came to the table with a guilty conscience in the face of unprecendented number of scams and scandals in recent memory and yielded to the popular pressure in the form of agitation and protests by Civil societies! And here BJP preferred sitting on the fence to fish in troubled waters as Congress did many times in the past!

If BJP had opposed the meeting with Hazare team, this would be politically unwise. It was okay to allow opportunity to UPA and Hazare team to attempt drafting Lok pal. Now, it cannot be said that anyone caused failure of UPA Hazare team. BJP is correct to say that they will comment only when cabinet draft is ready.
BJP's game is clear enough to be seen by anyone and more the discomfiture of Congress on this score the greater are its political gains!!
The 'civil society' group of anna Hazare was struggling against congress led UPA. Now Opposition is another front for anna to fight against. Indeed a great task before 'civil society'.

I think the movement led by Anna Hazare is just the manifestation of a strong desire to fight corruption of a mjority of people and not directed at any particular party or motley group! BJP too did not shine in glory in fighting corruption! Even its government in Karnataka stinks!
Almost every political party is corrupt. In fact, all people and all sections of society are corrupt. Corporate world is the corrupter. Even religious establishments of hereditary Gurus, good number in Punjab, e.g. Ram Rahim's Dera Sacha Sauda are deeply involved in corruption and malpractices. Film industry is no exception. There is hardly anyone who would not seek opportunity for extra money by any means.

It is no use blaming politicians alone. Everyone curses corruption where he loses and loves it when he gains.

Thus fighting corruption means that you fight against everyone.

We should concentrate more on fighting adulteration of food, drugs and fighting pollution as these play with peoples' health. After success on these fronts, other sectors may be touched.
I beg to disagree that all sections of our society are corrupt and this is not the realistic position.There are decent numbers who are above it.If corruption has to be fought off ,it has to be in totality!No fragmented appraoch!

Really decent and honest are too few. Some appear honest but this more because of their lack of opportunity or timidity or lethargy. There are two types of individuals- Honest but lethargic; dishonest but active and cooperative.

There are exceptions also but they are too few. But most people are corrupt owing to circumstances. We all work in an environment and as team member. When whole organization works as a team in a corrupt environment, no individual membercan afford honesty.

Thst is why I wish to stress that greater emphasis be given on eradicationg adulteration of food and medicines and saving environment from pollution. This is of paramount improtance for peoples' health.
We never knew that Pranab Mukherjee is also a great humorist. He unwittingly satired himself and his organization by suggesting that BJP and Left are patronizaing 'civil society'. It is an established fact that Congress patronized Hazare as well as Ramdev by giving VIP treatment to them and also forming a Lok Pal drafting committee including 'civil society'. Is it not funny to say that BJP and Left patronize 'civil society'. IOn view of 'civil society' members already having used a lot of energy and time in drafting the bill, it is okay that opposition leaders also get view point of Hazare and his team. Afterall the bill is to be ptresented in parliament where opposition will also discuss and vote.

So far as my knowledge goes Mr. Pranab Mukherjee is not only a homorist but an opportunist of a dubious variety.It's correct to say that Congress party has thoroughly messed it up and initially warmed up with the idea of striking a deal with Hazare and has been making all kinds of laughable noises!

The number of honest people in any age has always been small but their contribution to the civilizational progress has disproportionate to their small number - it has been pioneering and path-breaking. I remember with great respect the role played by late G.D.Shourie the father of Arun Shourie in enactment of RTI Act which is such a potent weapon in the hands of us!
