Proposal to implement equal property rights among couples in India..

The proposed bill proposes that all movable and immovable assets acquired by a married couple or a couple living together be classified as joint property which would be divided equitably in the event of separation or desertion... of course ,
the proposed amendment that is being discussed by a panel of high ranking officials will have to be tabled in both the houses before it can be succeessfully passed .
Wonder how long that would take ? :huh: :dry:

There is no need for new law. When a husband deserts his wife for his own fault, wife can still claim compensation. Husband's wealth, income, living standard etc all are considered by court while granting periodical or lump sum compensation to the woman

Yes you are right.There are already a law regarding this for compensation.

The compensation is given in lump sum or monthly installments. The quantum of compensation of alimony is decided taking in consideration pecuniary circumstances of husband as well as wife and living standard used to. It is necessary to consult an advocate specializing in family matters. There are separate family courts for such cases.

Actually, in Maharashtra every couple buying a new flat or real estate property, it is mandatory that the legal registration bear both the husband and wife's name and carry their signatures so it is entitled to both. This has been implemented since last 4 years, maybe before, but I am aware of it only since last four years. I think it is a quite fair proposition for women's security.

That is true ! The problem with most women who walk out of a marriage is that they are broke with no means and engaging a lawyer is not easy since the good ones are expensive....That's how they agree for a compromise and take what is offered which is normally a pitiable amount !

I dint know this Kalyani, it is really a progressive step like they have in most western countries.I wonder if other states in India have this, not here in Karnataka , that I know...It is definitely a very fair proposition for both since they already know what they are getting into , what the implications are , and will not register unless they are sure !

The problem is that the men are largely against such a move.One can gauge that by their reactions on the net whenever there is a debate on such issues .It is not possible to gender neutral laws in India like one of the executives suggested because we have still not reached that stage of emancipation where ladies have equal rights and financial freedom to do as they want...
This is good. Actually both husband and wife has 100% ownership on the property of each other. Legally 50% ownership right bill will be passed is not bad.
Either way it will be done or has to be done, since more than half the population in our country is women and their votes are precious. I have a feeling that the bill will be tabled a few months before the general elections are announced just get the maximum leverage out of it ..

Thats true ! There are already many politicians and even the general public opposing the bill, so one can never say ..they may keep it hanging indefinitely !!!!!
