It is apparent that a governor cannot be lawfully removed before completion of term. Ms. Sheila Dixit refused to resign. But the central government has no lawful way to remove her. It is reported that she is being transferred to Nagaland. The very fact that instead of removal, she is being transferred goes to show illegality in the action of newly formed central government to seek removal of the governors.

There has been a practice in Indian politics of a new government asking Governors, who were appointed by previous regimes, to quit following transfer of power at the Centre.

If such practice were lawful, Sheila Dixit could be removed. Instead she is being transferred to Nagaland as a punishment just as government employees are sent to far off places as punishment.

Yes, it's a punishment. Nothing short of witch hunting which is undesirable. Yes, if there are precedences, let Shiela be removed on those grounds.

Nio. she cannot be removed that way. There is no misconduct attributable to her and there is nothing to justify her impeachment. .
It will be great service to the country if super cool ???Shiela Dixit ,who has shown what a leech she can be when it comes to furthering her self interest at public expense, is removed from politics altogether.! With all that she still wants to show her power although it is well known that UPA has done worse during their tenure !

What NDA has done is according to earlier precedences. Many Governors resigned with dignity because of earlier precedents. Sheila is also aware of this. Still she clings to her seat Nothing but hunger for power.

Refusing to accept unlawful order of the new regime does not tantamount to hunger for power. If they have any legitimate reson to sack her, let them remove her lawfully. Here the dignity of the rulers at center is more at stake. Case of Sheila Dixit differs from others. Still she has more than four years tenure left. Also there is no CBI or other enquiry for which she may quit her post. In fact, dignity of the center is more at stake. Why do they want her to resign. Is this not for accommodating some of their own men? Sheila dixit is not boud to accept any precedents that are not according to law.
I do not think tranffer to Nahaland if this is true of course as all been speculation in media, is a punishment transfer, it is a state of India union just like kerala. It is apparent that a governor cannot be lawfully removed before completion of term. Shiela's ower hiunger is no secret and thats the sole reason why she was booted out of power in Delhi ...As far as NDA wanting their people , it is a precedence started by the 60 year old grand party so why do they now resist when their practice is being followed ? why not give in with dignity instead of holding on and being shunt out ! I sincerelly hope that Shiela gets what she rightly deserves since she and her kind are a curse to our nation...

Exactly. How the other governors resigned in a dignified way ? Because they knew the reason for the center asking them for resigning. Cant this much of wisdom did not prevail on this seasoned politician?

If they can remove Sheila Dixit lawfully, let them do! Otherwise there is no sense to seek her removal especially when there is no case against her. She lost in Delhi assembly elections as part of democratic process. This is not relevant to her tenure as Governor.
Shiela Dixit is not clinging to governor's post because she is power hungary. She is afraid of being investigated and possibly prosecuted by a new government in Delhi State. In fact AAP had launched the process. As governor she gets protection from these and this is why she wants to continue as governor. Why should NE States be used for dumping unwanted governors as was the Gujarat governor who was to retire in November this year. So vendetta is also reason for transfers. I also feel that when there is change of government political appointees should resign on their own.

What is the constitutional position? The new government is unable to terminate her appointment constitutinally. Elections/ appointments for all offices are independent and are not related to union government. Now a counter question- should all CMs also resign when a new government is formed at center? Every incumbent of an office should be allod to complete his full tenure except when there are allegations of misconduct duly established. There is no way Sheila Dixit surrender to blackmail by the new rulers at center.

The governors are appointed by the ruling party in the Center and most of the time they are members of that political party. Therefore when the ruling party at the center changes ipso facto a new ideology comes into power. The governors are of the out voted ideology and can come in the way of the new ruling party. It is therefore expected that the governors will resign indirectly bowing to the will of the people. As CM's are elected members they need not resign if a new government is formed at the center because they draw legitimacy from the people. So I would not call it a blackmail by NDA and Sheila should have resigned but because of her prosecution fears she is using the constitutional position and may be willing to go to any other state but remain a governor.
Vandetta is just a figment of imagination. What NDA has done is implemented a rule that's in practice.
'The rule in practice' is not helping the center because this is unlawful. If this were okay, they would have removd her instead of planning transfer to Nagaland.
I agree, its not a rule but there were precedences earlier which went on smoothly. Additionally, Shiela Dixit could have learned from some governors who resigned. This is doggedness to create an uproar.

It is well known that the governor of Gujarat did not see eye to eye with Modi on many issues. So now that NDA govt has come to power they have transferred her to Nagaland when they could have allowed her to finish her term expiring in a few months in November. Everyone in Gujarat was waiting for her either resigning or getting transferred ever since NDA came to power. It is vendetta in that sense. Vendetta can be taken even under rules. I am not holding it against NDA as she also trouble Modi a lot. It is tit for tat under rules of course.

Absolutely. many a time even if there are no rules, its customary to quote precedences and follow accordingly for smooth running. A governor should be magnanimous without being dogged. Sail along the current. That's what i wanted to say.

Being magnanimous in politics today is an outdated concept. Political positions are no longer a service but a privilege which the holders find it very difficult to give up. They are ready to be humiliated but will cling to their posts
