deven rana created new article A Take on Section 66A,69 and 79A.
In this article, we will cover other provisions that have attained a degree of notoriety in recent times for their effect on suppressing online freedom of speech and expression but before we get down to such laws let us first shed some light on the difficulties that India as a nation faces in maintaining a balance between keeping the cyber world free of crimes and anti- social elements and at the same time safeguard the right to freedom of speech. India is the largest democracy in the world and perhaps the most diverse country in terms of cultures and religions. It has a past filled with violence and religious riots hence it becomes almost imperative for such a nation to have restrictive laws in place in order to make sure that incidents of the past are not repeated. Having said this, freedom of speech is the fundamental right of every human being which cannot be compromised at any cost. So, India should try and improvise its laws in such a manner that both the harmony is maintained and the freedom of speech remains intact.
March 24th,2015 was truly a pivotal day in the history of Cyber- laws and laws governing Social media in India. It has already been covered in the previous segment of this assignment that in a landmark judgment by the Supreme Court of India struck down Section 66A which gives power to the police to arrest citizens who have posted “Offensive” content on the internet. This should be seen as decent start in improving the existing laws that undermine the right to freedom of speech in the cyber world in India and formulation of laws that are fair to both parties but there is still a long way to go. It must be noted here that although some of the sections of the IT law pose a serious threat to the right to freedom of speech but their existence is very crucial in order to keep the society secured from antisocial elements. The laws have to be modified in such a manner that the crimes on the cyber world are kept in check and at the same time the freedom of speech of the common man is not compromised.
In the recent past there have been a number of instances wherein the freedom of speech of the people has been compromised and as a result many petitions have been filed challenging the constitutionality of sections like 66A, 69A and 79 because of which there has been uproar in the entire nation. Section 66(A) which was on similar lines as the Section 188D of the Kerala police act gave immense power to the police to arrest citizens for content that is seen as offensive, the terms set for which are very vague in nature. Although The Supreme court struck down section 66A there are a lot of sections still in existence that are a major threat to the right to freedom of speech.
What about Section 69A?
Section 69(A) of the IT(Amendment) Act, 2008, allows the central government to block content where it believes that its content threatens the security of the state; the sovereignty, integrity or defense of India; friendly relations with foreign States; public order ; or to prevent incitement for the commission of a cognizable offense relating to any of the above. The Government adheres to a set of rules and protocols while doing so which have been termed as the Blocking Rules. Blocking done under this section is not a take down with which it has been misunderstood many a times. Technically, a take down is defined as the removal of content by an online platform such as twitter, whereas block disables access for a user through an internet service provider such as Vodafone.
The problem with this section is not the blocking of the sites but the manner in which the blocking is done by the government. The government has routinely blocked content on websites in absolute secrecy without the scrutiny of the judicial bodies which is very threatening for the right to freedom to speech. Online blocking was in news recently when on pretext of stopping the spread of propaganda of terrorist groups like ISIS in India the government went on to block entirely innocuous site like Github.com without any pre-decisional hearing to the originator of the content before blocking was carried out. While the rules indicate that if the originator is identified, the hearing is mandatory to be given to him or her. However, in practice it is never followed. In fact, there has not yet been a single instance wherein the originator has been given the pre-decisional hearing before blocking the content. The RTI applications that have been submitted have either not been answered or have come back with an incomplete explanation.
The constitutional challenge put up by the People’s Union for Civil Liberties is not based on the blockings being done but it is done on the manner in which these blocking have been done. The court has rejected the challenge on section 69A stating that under the rules if the originator of the information is identified then he/she is entitled to a hearing. Notably, the court also specified that the reasons for blocking have to be recorded in writing, so that a blocking decision might be challenged before the courts.
But like how every cloud has a silver lining, the silver lining in this case was that although the courts rejected the challenge to section 69 A, its stress on the need for a written order in case of blocking will certainly increase transparency substantially.
And what about Section 79 ?
Section 79 of the Information Technology Act 2000 says that Intermediaries, websites like Google, Yahoo, Facebook etc are not liable for third party information if they observe due diligence while discharging their duties. It provides immunity to intermediaries and protects them against content posted by users on the site. It seems imperative to immune the intermediaries as it is simply impossible for the sites to monitor the amount of data that gets uploaded every day in real time. Intermediary immunity is essential for the very existence of many of the websites that we have come to depend upon.
However Section 79(3) contains a brutal exception to this immunity. According to this Section, if an intermediary received "actual knowledge" of illegal content that had been uploaded, and if it failed to remove or disable access to that content, it could no longer claim immunity. There is more to it. If the sites get informed about the offensive content by an affected person then the site has a time limit of only 36hrs to remove that content. This seriously undermines the freedom of speech .The individual is more likely to complaint for some content keeping his/her own personal reasons in mind and the intermediary , under the pressure of section 73, would most likely take down the post. This is a big challenge for this section. If we look from a business perspective of the intermediary, determining whether the content is offensive or not, would result in a great deal of legal liabilities that would hugely impact their profits. An example of an Indian intermediary is mouthshut.com. The company has filed in a petition challenging Section 79.The court responded positively for Section 79 It held that "knowledge", under the Act, was limited to cases when either there was a court order directing take-down, or a government notification. This introduces an important procedural safeguard, since it spares intermediaries from having to decide for themselves when online speech is illegal.
Concluding this section of the assignment I would say that yes by striking down Section 66A, the court has done away with one of the most oppressive censorship laws this country has ever known. It is not a complete step but it is definitely a vital first step.

Mousumi Ghosh created new article Not there yet!.
Well, I have shifted to Hyderabad and it is almost six months. This is my second visit to Hyderabad. I am not new to this place as I did my masters from Hyderabad Central University. But this time around I moved to Hyderabad for my job.
I am still trying to settle in this place, trying to settle in my job, and trying to remain a good, responsible mom, in addition to being a good professional. Juggling with two roles can never be a cakewalk. You must be thinking what the intent of my post here is. Well, this post is about my tryst to find a good daycare and play school for my two year old.
In an attempt to frantically search for a good play school and daycare, I have visited many a playschools. Here is my take on many such schools.
For the good of all the playschools and for the safety of my baby, I will not reveal the names of any playschool here in my post.
Most playschools, which have the word ‘INTERNATIONAL’ appended to their names, have nothing International about them. The most obvious reason being that the food that is served purely caters to people who belong to South. Not all kids like eating Sāmbhar rice, curd rice, besibhiley Baath, and so on. Few caregivers physically abuse children in order to keep them from crying. This kind of behavior is not only inhuman but can cause a permanent scar in the mind of a child. Please note that in order to become international a daycare has to offer food that can accommodate the needs of children coming from across India or globe.
Secondly, most schools cum daycare extract a huge amount of money from the parents in the name of providing air-conditioned rooms, food including in-between snacks and CCTV camera access. However, in reality they never provide access to camera footage in case something goes wrong. This daycare, which boast of being in this daycare and school business never ever inform parents if the child falls or gets hurt. In fact, as a parent if you go and ask, they would come up with hundred stories instead of admitting their fault. Instead of maintaining a good child is to teacher or caregiver ratio, 10 toddlers are stuffed in a small room where they have to spend close to nine hours a day. How the kids who need ample air and sunshine to grow stay in a closed, suffocated room? Not many parents are bothered to question the school authority any way.
Most people these days step out of their homes for job and hence a secured daycare is all the more in demand. Nevertheless, few people just use this as a business and do not really operate the school from an educational point of view. In an attempt to ape the West, such schools do not give any books or sheets for the parents or kids to look at. In addition, these schools make outings and trips outside the schools a must. The school authorities make these field trips important from an educational perspective, which may not be true.
My point here is who should we complain in case there is something wrong happening in daycare cum school. The only option left with parents is to change the daycare and look for a new school yet again. However, this does not mean the new school or daycare will turn out to be a good. It is again left to the parents to continue or look for a yet another daycare or school. Well, all I will say is be very sure of what you choose for your child, because schools and daycare at an early age form a long-lasting impression on a child’s mind. Investigate about the school thoroughly; ask friends, neighbors, people staying near the schools to make an informed decision before you take the plunge. Check if the schools are reluctant to show you the school on your first visit or they welcome you and your question. Try to see if they are trying to be very goody goody and make false promises or they really keep up their promises. Talk to other parents and ask them about their experience. If these things still do not work, follow your gut, instinct and then make a choice. After all, we don’t trust our maids with a bag full of money, then why trust them with our most precious valuables (our children) with them.

Bajirao created new article Bloating of Face- Is it really serious?.
You might have seen many people (especially male youngsters) with bloated and swollen face. Most of the time people think its because of drinking excess alcohol. Alcohol is one of the reason but there are several other reasons that contribute to facial bloating.
Swelling over the face is due to the accumulation of water or fluid in the soft tissue of the body. The swelling / bloating/ puffiness of face occurs due to several reasons.
Lets go through them in detail.
Bloating of face once in a while is not serious however recurrent occurrences can be dangerous and need immediate attention.
Dehydration is one of the important cause of facial bloating or puffiness over your face. People who drink less water mainly suffer from facial puffiness. Excess alcohol intake usually causes dehydration, where water level in body goes down. In such situation, kidneys conserves water by increasing absorption of water that is stored in the soft tissues of our body.
Puffiness can be also due to poor diet and lack of essential nutrients in your body. Deficiency of vitamin C and vitamin A can cause facial bloating.
Some kidney diseases like nephritis, nephrotic syndrome and kidney failure lead to swelling around the eyes and feet. These kidney diseases disrupts the proper functioning of the kidneys and thus affects the process of absorption of water from the body.
Lack of thyroid hormones on the body (hypothyroidism) results in rapid weight gain and makes the face bloated. Along with puffiness of face, people suffering from hypothyroidism also complains of constipation, dryness of skin and generalized weight gain.
Allergies and insect bites causes puffiness over face due to allergic reaction. The swelling and puffiness is usually present at the site of bite in case of insect bite or generalized swelling in case of allergic reaction.
Fat face is a serious concern faced by many people. Such people even though not overweight, their face seems to be fat and puffed, it is due to the fact that their body tend to collect the fat around the cheek and chin areas which makes their face look as if bloated.
Sinus inflammation also causes facial bloating. In such kind of infections, the facial bloating develops gradually and the person my show other symptoms of the infection along with the bloating.
Knowing the cause for facial bloating would help to treat and prevent the recurrences.

vijay created new article 'Sholay' Revisited .
The only reason I remember the iconic movie Sholay is because it was only in my fifth attempt that I could manage a ticket to see it. Even offering relatively higher prices in black did not succeed, such was the pull of the movie. It was released in August, 1975 and is these days celebrating forty years of its release.
What explains the phenomenal success of Sholay? It has till date earned around Rs 720 crores, highest by a Hindi movie and that too beginning with comparatively very low ticket rates in 1975. Its story is based on the recurring theme of revenge a very common plot in countless Hindi movies. Many critics have said it was at best a B grade Hindi movie. In fact the film reviews at its release gave it average ratings which could not have predicted that it would go to become an all time favourite.
What sets it apart from other Hindi movies/ In fact a critic has gone to the extent of saying that it was not an Hindi movie and that is what made it a phenomenal Hindi movie. Unlike typical Hindi films it was low on emotion content, though the characters were involved in a emotional revenge saga. It was the first film to present characters devoid of the overburden of emotionalism that made audiences weep in the theaters and clutch to their handkerchiefs.
For the first time characters had a distinct personality of their own without overriding inter plays. This gave the characters scope to make their presence felt on the screen. Even incidental characters with two minute roles left an inedible impression on the viewers. The masterstroke was the creation of the character Gabbar, a rustic dacoit who did not live in luxurious surroundings full of buxom companions and torture chambers. Gabbar was as crude as they really are, full of venom and gutka chewing and cruel because of the omnipresent insecurity in a dacoit's life.
According to me Sholay became a super duper hit because of the character Gabbar, the simple but crisp dialogs by Salim-Javed and the appropriate location in Karnataka. Rest all fell in place automatically. This is not to say that the director, Ramesh Sippy, did not have significant role. He had. It was he who saw potential in the story and selected the appropriate actors for the various roles. For Gabbar's role he had selected Danny Denzongpa but he could not give the dates. Then Javed remembered that Salim had told him once about a powerful performance by Amjad Khan in a stage play he had seen. Amjad was called and his screen test was a hit and Sippy signed him up for Gabbar's role, which even Amitabh Bachchan wanted to do. Wonder how he would have done the role. Sippy also spent time to locate a proper location and finally settled on a rocky location near Bangalore. As a director with a tight script, well defined characters and excellent actors his job was simplified considerably.
Sholay also became a hit because of the many first technological incorporations both in audio and visual aspects which made the film comparable with Hollywood films and audiences loved these. The galloping horses falling with their front feet collapsing gave it an effect of reality. The sublme shots of Jaya in white saree lighting the evening lamp with an adoring Amitabh watching remains with you for a long time. The blabbering with a chatter box Basanti played by Hema and Dharmender adds spice to the film. The 'soocide' shot featuring Dharmender has now become a classic.
However it was the dialogs of the film which caught the fancy of the viewers and they have now almost immortal Simple but effective. "Kite aadmi the" by Gabbar became famous the way Amjad said it. Otherwise by itself it was a very mundane dialog. So has the "chal Basanthi -- " by Hema. Who can forget the impact of the dialog "itna sanaata kyon hai bhai' by blind Maulvi played by the veteren Hangal. Another one "Basanti in kutton ke samne mat nachana' by Dharmender or "Yeh haath mujhe dede thakur" by Sanjeev Kumar or "Basanti tumhara naam kya hai" by Amitabh or " Ham angrezoon ke zamane ke jailor hai" by Asrani or " Hota Bhopal -- " by Jagdeep have all become legendary. One can go on. The dialogs of Sholay were released in form of a record by a recording company and it did a roaring business.
Sholay came just when the Emergency was declared in the country and its vice like grip was beginning to stifle the masses. Did it have any effect on viewers thronging to the cinema halls is difficult to say.
All in all Sholay was a trend setter and today many times film history is written as pre and post-Sholay. It has indeed become a milestone in Hindi films. It gave a boost to writers to develop strong characters and liberated them from cliches in which they had got trapped. The maturing audiences liked this welcome change and the canvas of stories became wider.
However all films become hit only in their times. As times go by, tastes of audiences change . It is doubtful if Sholay were to be released first time today it would become such mega hit.
In conclusion I narrate what a grandparent known to me told me. A couple of years back Sholay was re-released with some publicity. He took his 11 year old grandson to show him Sholay after praising it very much to him. Midway in the show the grandson became restless and forced his grandparent to walkout of the hall. The young lad told him how can we withstand such bore movie. How times change.
However in the history of Indian cinema and especially Hindi films Sholay has a very high place for its many contributions and the extraordinary reception it received from the film goers.

ABSIVAKUMAR created new article Managing Indian bosses.
There are always two rules, when it comes to managing bosses. The first rule says that the boss is always right. The second rule says that if you have any doubt, you must refer to rule number one!!!!
While these rules may be very universal in nature, in Indian conditions, they are the perfect recipes for success.
Let me explain.
Bosses are also human beings who belong to the wider society. In as much as this is true of Indian bosses, as much as it is true of any other category of boss anywhere else, it is particularly true that Indian bosses have a huge behavioral trait of insecurity that is part of their psyche.
This is exactly why bosses behave the way they do. They will cultivate any number of chamchas who will simply obey whatever they will say or order to do. In fact, these chamchas also have some very dangerous habits, which will be discussed in the next few paragraphs.
The chamchas of the bosses are very dangerous people. They will stoop to any level to butter the bosses, and get their own things done.
Sometimes such chamchagiri, as it is called in Hindi, goes to ridiculous levels. For instance, if some relative of the chamcha is an expert in astrology, and the boss has a weakness for astrology, the chamcha exploits this to the maximum extent, and gets things done. Out-of-turn transfers to safe departments, useless "on duty trips, and even sanctioning of overtime is done by the bosses.
What can one do in such a situation? Very simple. The first alternative is to keep a big distance from such people, and continue to do the best that one can do. Of course, there will be any number of frustrating moments when those who are merely chamchas are rewarded. One has to just ignore them and the situations they create and move on.
Professionals are always respected by many organizations. There are any number of instances where such professionals will get noticed and no matter what happens, they continue to shine. So, the aligned work that needs to be done is to pick up whatever professional expertise is possible in the given context and move on. However, a wise strategy will be to give the boss some minimum respect but never stoop down to the level of the chamchas who always look for opportunities to put down people with some respect or talent or expertise.
The best way in which one can overcome such situations by cultivating some good relationships with bosses of aligned departments. For example, if one were to work in the HR Department, there will be huge interface with the accounts and finance departments. Once the work of the individual gets noticed, there will be several people who will not hesitate to appreciate the good work of the individual in some context or the other.
However, the professional has a big choice: he or she can simple transititon to a better organization where the only consideration that matters is merit. For instance, Marico Industries, Mumbai is reputed to be a very professionally managed organization, even though it is a family managed organization.
What happens if the boss is very good and nice, and does offer a good number of opportunities to develop himself or herself? The universal answer is that he or she should go all out to make maximum use of such opportunities, but more importantly, create situations where things become very easy for the boss. This will help the boss to get himself or herself free from routine tasks and concentrate more on the strategic ones. For example, there is always a huge amount of data that needs to be organized for the boss's attention, if one is working in Marketing. The data may pertain to competitor moves, new products, feedback from existing customers, specific customer complaints and so on. Once the data is presented to the boss, the much larger and more important decisions can easily be made.
For instance, it is quite easy to understand why FMCG companies target the middle class. However, if a shrewd competitor targets the lower middle class and comes with a very innovative and value for money product, it should bother all the companies in the existing market. For, there is every chance that the existing customers may prefer to buy the cheapter substitute, since it is seen as a good value for money spent. The vital data will help the Management come out with counter strategies to face the challenge of the new product.
There are bosses who are neither here or there. These are the "blow hot, blow cold" bosses. They would venture out to be very kind and considerate one particular moment, but would go full blast the very next moment. Their behavior is largely ego driven, and there will be a number of situations when they would expect to be praised by someone. In the Indian context, it does pay to butter these bosses to a limited extent, and praise them, but bring to their notice the good work done, anyway. This will help the individual to have a good number of opportunties to develop, and take on the challenge of the unknown.
As regards autocratic bosses, the only strategy that will work, is to make the boss understand one's merit, when the opportunity arises. Even the worst of autocratic bosses get to smile a bit, when the situation is light and informal. During such occasions, it does pay to establish a personal contact with the boss and explain the good work done.
The democratic and team-work oriented bosses are the best, as they create situations where individual merit is recognized, but where team work is also encouraged and rewarded. It does pay to not ony do one's work, but also chip in with some effort to get the work of other's done. In situations where some personal work gets the colleague entangled in some problem, and he or she is unable to attend the regular work, if the individual chips in and gets the overall work, the boss immediately sits up and notices it.
Hence, managing the bosses in the Indian context, would depend much on the situation. A whole deal of tact and patience is required to be successful in this art.
Indian bosses have particular characteristics. Those from South India, for example, are more religious minded and do not have much of a social life. Those from the North of India, for the most part, do enjoy night life and like boozing. Having the ability to navigate situations outside work, and engage such bosses is also very important. It is not wise to simply shy away from the non-worklife of such bosses.
Another aspect that requires serious consideration is developing personal relationships. Many bosses do like to develop personal realtionships with their subordinates in Indian conditions. They go all out to develop such relationships, with members of the family, and visit the houses of their subordinates. If this is the case, there is no harm in reaponding very warmly and doing all that is possible to nurture such relationships. It does pay to encourage such bosses to even develop such relationships. However, most of such bosses draw a big line in keep the personal relationships and the official tasks as two different entities. This is exactly how it should heppen as well.
Thus, the personal relationship angle and the after work-life time spent with Indian bosses are important in Indian conditions.

In addition to the physical asanas, yoga involves Pranayama, Meditation and practice of moral virtues in life. It is a complete package that makes a person towards perfection in physical, mental and spiritual levels. How it can be considered as Sports? Sports refer to competition and entertainment. How can Meditation and Pranayama include in a competition, without destroying their dignity? It is OK with respect to asanas only. Then it should be corrected as ‘Yogasana is recognized as sports’, but not Yoga, which is a whole package.

Lopamudra replied to the topic Should the 'No detention policy' be scrapped?.
Yes, as I had mentioned earlier, students have started taking their studies very lightly as a result of which the performance level has gone down. So, scrapping the policy seems to be the answer. Nevertheless, one can only hope that the number of school goers don't drop and parents can be convinced to keep sending their children to school to maintain the literacy level. As mentioned by some Educationists, making the policy applicable till class 5 may not be a bad idea as it would be in sync with RTE for all..whatever be the final decision, one can only hope for progress in the positive direction.

In my city Vizag there are a plethora of of Yoga camps which are of free cost and Yoga teaching institutes including advanced Yoga classes are held. But I never utilized these camps or classes. I learned Yoga through Books. Many people are under the impression Yoga should be learned under the supervision of a Trained Yoga expert. And it is the 25 year of my Yoga. No BP. No sugar, No nothing.
Incidentally i just got out after completing my Pranayama.

I am not aware about your area but in our part of the country yoga camps are held in each city free of cost at a regular interval by trained Acharyas with lots of people attending them regularly for entire duration of the camp. By the way the famous Patanjali Peeth of Yoga of Ramdev is only 110 km from my place which allows free yoga classes.

You are talking about institutions which teach Yoga. But for coaching Yoga as a Game, we do not have any coaching academies. Like many academies are there to teach Badminton and cricket academies to teach cricket ( Sehwag is running one). Now coming to the point to teach Yoga as a game Yoga academies can be introduced which offer employment to many people.

In fact there are so many free coaching camps by yoga gurus and their followers there are too few chance a person will spend money on learning something by making a payment for that... unless of course our government decides to appoint yoga teachers in all schools.

When people are able to practice Yoga without any teacher , there is little scope for job creations.. And even if that is true it will not be in great numbers ! The idea no doubt is to encourage and popularise Yoga but they should be a little more practical about implementing it .

When people are able to practice Yoga without any teacher , there is little scope for job creations.. And even if that is true it will not be in great numbers ! The idea no doubt is to encourage and popularise Yoga but they should be a little more practical about implementing it .
